Application and reply forms
We will need a completed application form and reply form from the parties involved. If we need further information, we will let you know. The case will be assigned an assessor and case manager. In most cases, you should hear from your assessor within three working days of our having all necessary details, and be given a date for an initial meeting.
Initial meetings and mediation
At the initial meeting the assessor will explain his or her role, and discuss the case and how it will be handled. The initial meeting will not normally involve the other party. The assessor will discuss with you whether you want to mediate, or negotiate, a solution. If so, a further meeting, or series of meetings, may then be arranged to see if agreement can be reached.
Investigation
If no agreement is reached, the assessor will carry out a full investigation and collect the evidence. This is an informal and flexible process, and you can put forward evidence and comment at any time. The assessor will generally see the parties and witnesses on their own and without the other party present. The assessor will though pass on the result of interviews and ask for comment.
The assessor has the responsibility for investigating the case. We believe there is a benefit to you in having the assessor deal with the parties and the evidence direct. You are therefore not legally represented, and are not required to formally present or defend your case. This helps reduce the time and cost involved. It does not affect the thoroughness of the investigation.
Determination
You will be able to negotiate an outcome through mediation at any stage. This is encouraged and mediation can lead to very positive outcomes. If though a negotiated agreement is not reached, the assessor will go on to reach a decision and make an award that reflects your rights. The Centre will have the initial responsibility for ensuring any award (or agreed solution) is carried out, and we will ask you to give us the necessary authorities and information to help us achieve this.
Legally binding outcome
Any decision by the assessor will be final and legally binding on the parties and will dispose of the dispute.
