Application and reply forms


We will need a completed application form and reply form from the parties involved. Once we have these, we will confirm that we can take on the dispute.   If we need further information, we will let you know.  The case will be assigned an assessor and case manager. In most cases, you should hear from your assessor within three working days of our having all necessary details, and be given a date for an initial meeting. 

Initial meetings and mediation


The assessor will explain his or her role, and discuss the case and how it will be handled. The initial meeting will not normally involve the other party. The assessor will discuss with the parties whether they want to mediate, or negotiate, a solution, and a further meeting, or series of meetings, may then be arranged to see if agreement can be reached.

Investigation


If an agreed solution is not achieved, the assessor will carry out an investigation and collect the evidence. This is a flexible process, and the parties can put forward evidence and comment at any time. The assessor will usually see the parties and witnesses on their own and without the other party present.  The assessor will though pass on the result of interviews, and any evidence obtained, and invite comment.

The assessor has the responsibility for investigating the case.  We believe there is a benefit to the parties in having the assessor deal with the parties and the evidence direct.  The parties are therefore not legally represented, and are not required to formally present or defend their case.  This helps reduce the time and cost involved.

 

Determination


A negotiated solution will remain possible throughout.  If a negotiated agreement has not been reached, the assessor will reach a decision and make an award that reflects the parties’ rights. The Centre will have the initial responsibility for ensuring any award (or agreed solution) is carried out, and we will ask you to give us the necessary authorities and information to assist us to achieve this.

Legally binding outcome


Any determination made by the assessor will be final and legally binding on the parties and will dispose of the dispute.

Cost and time estimates


We recognise the importance of disputes being dealt with quickly and cost effectively, so that you can remain focussed on your business.
